1. Contract agreement
It is agreed that the terms set out below is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

2. Special Requests/Coverage
The client understands and accepts that the all coverage will be as the cameramanʼs professional expertise determines and that no one aspect will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the clientʼs wishes. Any special requests not notified in advance must be made by the client to Infocus360 in writing.

2.1 Prizes and Donated Services
All prizes and donated services are strictly non transferable and only available to the original recipient. All prizes and donated services have NO cash value and cannot be used as part payment or full payment of another service. Prizes and donated services may be withdrawn at any time if unreasonable demands are deemed to be made. All prizes and donated services are given as an individual service and are in no way payment or in return for any advertising or any promotional service. All prizes and donated services stated values & names are for a similar commercial package and for illustration purposes only. All prizes and donated services contents are stated when donated and are for the service agreed and cannot be changed without prior agreement or additional costs being incurred. All additional costs incurred are deemed as a separate booking and are covered by our standard terms and conditions.

4. Infocus360 cameraman
On occasions and without notice it may be necessary for the cameraman originally specified to be substituted by another cameraman, (e.g. due to ill health).

5. Images/Videos
All file sizes are nominal. Infocus360 will provide an appropriate colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film/digital the exact colour as seen by the human eye.

6. Retouching
Infocus360 will perform a standard amount of retouching to take the photographs and video to a quality of which they are proud or agreed with the client in advance of the edit. Further retouching, digital manipulation and artist finishing is available to the client as an optional extra.

7. Copyright
Any images, videos or copies, whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such files are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means are created as part of this contract without the permission of Infocus360 in writing.

Infocus360 retains full ownership and copyright of all images and videos captured unless written permission has been given to confirm otherwise. Negatives/digital files remain the property of Infocus360.

Unless stated otherwise in writing, all clients give Infocus360 full permission to use any and all images/videos captured in it’s portfolio and business marketing material. This includes editing and manipulation in any form to promote the services offered by Infocus360.

8. Artistic license
Infocus360 shall be granted complete artistic license including in relation to the poses captured and the locations used. Infocus360 will use judgement regarding the locations/poses and number of images/video taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to complete all requests.

9. Force Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

10. Previews
Although the Infocus360 will do their best to produce more proofs/preview images than as discussed with the client, there is no guarantee that any particular number of proofs/preview images will be produced.

11. Display
The client hereby allows Infocus360 to display any media included in this contract in their studios, portfolios, literature, exhibitions and advertising. No use of the media will be made by Infocus360 for other commercial reason except with the written permission of the client.

12. Cancellation
The client may cancel this contract at any time by giving written notice to Infocus360 but in doing so shall forfeit any monies paid. Should cancellation be received by Infocus360 less than 30 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 75% of the contract value. Should cancellation be received by Infocus360 less than 14 days prior to the date of the ceremony, the client shall pay an additional amount so that the total paid by the client is equal to 100% of the contract value. The said sum shall be payable as compensation as an estimate of the loss Infocus360 would suffer.

13. Limitation of Liability
In the unlikely event of a total equipment failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

14. Complaints
Any complaints should be raised by the client with Infocus360, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of project completion.

15. Unreasonable behaviour
If for any reason our staff encounter any unreasonable behaviour or abuse in any way while carrying out their duties they reserve the right to cancel the services, any monies paid will be forfeited.

16. Payment
Deposits must be paid to reserve any dates, all dates are available to other clients until the deposit is paid. The balance is due 28 calendar days before the start of the project, if the balance remains unpaid after 2 reminders or is not paid within 21 days of the event Infocus360 assume that you as the client wish to cancel the booking unless prior late payment agreement is approved and confirmed by us in writing.

For last minute bookings payment is due immediately and is non refundable if cancelled.

17. Agreement
Having read the information on this page you agree to abide by the terms of agreement set out in it. You understand that the terms of this agreement cannot be changed unless agreed in writing. Infocus360 reserve the right to amend the terms on this page at any time and you should review them regularly. By working with Infocus360 you agree to these terms of service.
